RECENT ACQUITTALS

State of MN v. U.W. (2018)

NOT GUILTY– Our client was charged with Domestic Assault, Disorderly Conduct and 5th Degree Assault in Ramsey County after an argument with his wife. U.W. was represented by Justin Schiks and found “Not Guilty” of all charges at trial.

State of MN v. U.W. (2018)

NOT GUILTY – Our client was charged with Impersonating an Officer and Violation of a Uniform Code in Stearns County while working as a bounty hunter. S.P. was represented by Justin Schiks and found “Not Guilty” of all charges at trial.

Noteworthy Dismissals

State of MN v. J.M. (2018)

Client was charged with 1st Degree Controlled Substance and Ineligible Person in Possession of a Firearm in Pine County (a total of 4 felonies). He was looking at 15 years in prison if convicted in this case. Attorney Justin Schiks successfully challenged the legality of the stop of our client’s vehicle. The Court determined our client’s constitutional rights were violated as a result of an illegal traffic stop resulting in a dismissal of all charges.

State of MN v. U.W. (2018)

Felony Criminal Vehicular Operation and 3rd Degree Drug Possession dismissed by the prosecuting attorney in Pine County. Our client had turned her life around and gotten help for her drug addiction. Through Justin Schiks zealous advocacy and our client’s positive strides in sobriety, the prosecutor dismissed the charges.

State of MN v. C.B. (2018)

Operating a Commercial Motor Vehicle without Registration dismissed in Washington County. Justin Schiks was successfully able to show the international carrier had a logging device on the date of the offense resulting in a dismissal of the case by the prosecuting attorney.

State of MN v. J.Z. (2018)

Domestic Abuse Order for Protection Violation dismissed in Ramsey County by the prosecuting attorney after Justin Schiks was able to show the various issues in the State’s case and substantiated reasonable doubt that the offense occurred.

State of MN v. T.S. (2017)

Misdemeanor Theft dismissed by the prosecuting attorney in Winona County on the eve of trial. Justin Schiks turned down offers for resolution in preparation for trial. This case was dismissed as the prosecutor lacked key evidence necessary to implicate our client.

State of MN v. N.D. (2016)

Marijuana in a Motor Vehicle dismissed by the prosecuting attorney after our firm successfully challenged the legality of the stop of our client’s vehicle.

State of MN v. J.G. (2015)

Domestic Abuse Order for Protection Violation dismissed by the prosecuting attorney in Chisago County. After much discussion with attorney Justin Schiks, the prosecutor dismissed the case due to lack of evidence.

State of MN v. A.O. (2015)

3rd Degree DWI dismissed in Steele County after Justin Schiks successfully raised a post-driving consumption defense. The State could not prove beyond a reasonable doubt that our client operated a motor vehicle while intoxicated.

State of MN v. T.C. (2015)

5th Degree Drug Possession dismissed in Ramsey County in advance of trial due to insufficient evidence. Justin Schiks was able to demonstrate the State lacked key physical evidence necessary to implicate our client in this offense.

State of MN v. B.Z. (2014)

2nd Degree Drug Sale dismissed in Washington County. Justin Schiks went to trial on this case and the jury came back hung in favor of an acquittal. Rather than going to trial again, the State dismissed its case citing the likelihood that our client would be found “Not Guilty” in a subsequent trial.

Noteworthy Expungements

State of MN v. A.G. (2018)

Expungement of Domestic Assault and Disorderly Conduct granted in Scott County. Justin Schiks was able to prove by clear and convincing evidence that his client was eligible for a statutory expungement.

State of MN v. S.P. (2018)

Expungement of Felony Theft granted in Dakota County. Client has turned his life around after a youthful transgression nearly 20 years ago. Justin Schiks was able to successfully petition the court for statutory expungement despite objections from the Minnesota Bureau of Criminal Apprehension.

State of MN v. N.G. (2018)

Expungement of Engaging in Prostitution granted in Ramsey County. Client has successfully turned his life around. Justin Schiks was able prove to the court that our client was deserving of an expungement in order to maintain his high level security clearance position.

State of MN v. L.B. (2017)

Expungement of Domestic Assault & Disorderly Conduct granted in Goodhue County. Justin Schiks was able to successfully petition the court on behalf of this deserving client despite objections from various agencies.

State of MN v. A.T. (2016) : Expungement of 5th Degree Drug Possession in Washington County. Justin Schiks was able to show the Court that our client was deserving of this expungment despite almost every agency objecting to the sealing of our client’s records. Our client was nearly finished with nursing school and was held back by this conviction on his record.
